Need advise - marrying an immigrant would might be illegal, but under DACA

Hi all,

a coworker has the following problem:

Her son (US citizen, 19) is dating an 18-years-old lady from Mexico.

That lady lives here in the United States since she was 3.

The information that this lady gave to my coworker is confusing.

She would have a work visa, but that would expire in 3 years and after that, she could be deported.

I think that there are 2 possibilities.

(a) Her parents are legal, but not permanent residents (read: H1B visa or investment visa). In that case, she would have to leave with 21. However, I think that after 15 years, her parents should have been able to become permanent residents....so, I doubt that she has a legal status.

(b) She is illegal, but protected by DACA.

So, in case that they would marry (NOTE: A real marriage, the two have been dating each other for more than a year).....what would be the best way to ensure that she can stay?

I *assume* that she is illegal and has been brought into the US by her parents when she was 3.

Many thanks to anyone who can help/give suggestions,

Roland

PS: I am posting this in the English section so that my coworker can read the answers, too.
